  • Hyd visitor visa approval, later received 214(b) after 7 days of visa interview.

    Hi,

If any one can through some light on this would highly appriciate, as I had never come across this type of situvation on visa forms.

Me, wife and my son(7 years) attend visitor visa at Hyderabad consulate on April 22nd, and was told we receive our passports in 7 days. My wife got her passport back on 23rd, and my sone got his back on 24th April. I haven't got mine back.

I did sent an email to consulate subject saying "Pending passport for more than 5 days" , I got an email from consulate saying Passport will be sent to VFS. I waited 2 days and contacting VFS mean while, the answer is "my passport has not reached VFS" yet. so I did sent an email to consulate agian asking them about my passport. As we made travel arrangement to leave on May 4th.

With in 30mnts I got an email saying my visa was not issued based on 214(B).

why did they sent me refusal now? why not at the interview time itself? any idea?

I am a state government employee, and have good amount of inherited properties. I am currently doing my MBA too.

The questions VO asked us when we went were very straight and simple. We took interview in telugu, as my wife is not comfortable with english.

how long my sister in-law (my wife's sister)is staying in US?
    11 years
    what do i do here?
works for state government as assistent engineer
    how much is my salarey?
    xxxx
who else would stay with me in India?
    my parents.

she didn't even look at any papers we took with us.

that's all and wewere told, we will get our passport in 7 days.

now I got the email saying "Thank you for your correspondence of April 30, 2009 to the U.S. Consulate General in Hyderabad.

You had applied for a nonimmigrant visa on April 22, 2009. Your non-immigrant visa application received every possible consideration consistent with U.S. immigration law however it did not qualify for visa issuance under Section 214(b) of the Immigration and Nationality Act.

Our website: http://hyderabad.usconsulate.gov/214b.html has more information, in this regard.

    "
Are they going to send my passport and refusal letter through VFS now? how is that going to work?
what would be best thing to do now in my case?

Sorry to hear abt your case but you'll need to cancel your trip and reapply, there is nothing else that can be done. If its ok with you, your wife and son may travel since they got their visas.

Of note is their statement they you'll get your passport in x days, not approved visas. May be they needed to check something for your relative who works for the state govt and thus the time needed.
