    Please Help me. I need some advice.

    My husband is from Honduras and im almost 7 months pregnant with our first child. We got married in honduras last august. Soon after i got pregnant and we decided to apply for a B2 visa right away since i wanted to get back here asap to recieve my prenatal care and have the baby. Our life is obviously in honduras where we have a house and all the stuff we need. He doesnt even want to apply for a green card bacause he has no intentions of living here. He just has way too many commitments over there.
    So we were approved and came here around Jan 28th. The port of entry gave him a card stamped for 6 months maximum stay.. Unfortunately he only is permitted until july 28th... but im not even due until august 3rd.
    So what we are going to do is have him leave at the end of may (making it 4 months that he has been here so far in the US taking care of me while im pregnant) .. He plans to return no more than a month after leaving to apply for re-entry. I will be sending with him a letter from me kindly requesting my husband be permitted back and the circumstances, a letter from my parents stating he will be financially provided for for the duration of his stay, and a letter from my doctor proving im pregnant and due august 3rd, marriage certificate, etc. Him not returning here for the birth of the baby would be DEVASTATING to me and i cannot stop worrying and crying all the time just thinking about it. Any advice? does anyone believe he has a good chance of being re-admitted? Is there hope?

    File for an extension for his visa using form I-539 with a letter explaining the situation, evidence of the pregnancy and he will be "Allowed" to stay until he receives an answer from USCIS.

    His visa will probably be voided. But he should not have a problem staying until after the baby is born, even if the extension turns out to be denied (usually it takes USCIS a while to process these).

    How long do you plan on staying in the US with the baby before you move back to Honduras?

      Thats a good plan, not to leave at all and to apply for extension. You anyway do not care much abt the visa.

        petitioning undocomented husban

        I got married to my husband on Ausgut 25, 2009, He didn't have green card and he didnt have any kind of document to proof that he was legaly residence here in USA. According to my husband he didn't have a port of entry or visa from USA. He came from the Philippines. I want to file a petition for my husbad and I dont know what to do..Please help me.

          Did he entered legally or not? who the heck do you enter from Philippines without record?

          If he entered illegally he can not adjust his status.

              confused about invalid and invalid marriage contract

              I want to know that after marrying my husband, was our marriage an illegal or legal. what should I do after receiving the marriage contract, shall i ignore it or shall keep my previous lastname. How can i file a divorce?

                You are legally married, even if he is illegally present here.

                First you ask how to file a petition for him and now how to divorce him? are you thinking straight? It sounds like you are engaging in immigration fraud and you can go to jail for that!

                    filing a divorce

                    i am not the who wanted to file a divorce issue, it was my husband..he wanted to file a divorced.
