  • Parent Visa Refused Please Help!

    Hi,

    My parents visited to Mumbai consulate today for their Visiting Visa (B2) interview. They were not comfortable with English to I took the appointment in Hindi.

    So interview went well and at the end

    Visa Officer: Which Visa your son hold?
    Parents: H1B

    Visa Officer: can you show me please
    (my parent shows them the Visa Stamped copy)

    Visa Officer: this is expired visa with his old company’s name, where is the "new Visa".

    (my parents were knew that these is some I-797(Visa extension approval notice,) but they thought that Visa officer is asking for "new Visa" not the "extension approval" or I797)

    Parents: Sir we have these documents (they put file in front of Visa officer) and the documents you are asking for must be here, my son sent us everything, it must be there.
    (My I-797 were there in the documents file)

    Visa Officer: please give the new visa document.
    My Parents look back in the file but they could not understand that officer wants to see the I797,

    Visa officer waits for few seconds and said when your son (sponsor) will come back here, he will get the new visa and then u can come and apply for visiting visa.

    (My parents once more requested to see the documents and they said sir interview is over.)

    Visa officer did not even asked that do u have I797 (H1B extension etc), she was keep on saying new visa and my parents get confused.

    I think it’s entirely my mistake that I did not let my parents know that they need to show I-797 when officer will ask for new visa.

    How do I get the visa denial reason (221g or 214b)??? They did not get any at that time
    and also they did NOT get any stamp on the back of passport (that visa once been rejected)

    Should I have to start is all again?

    Please …please…kindly let me know what to do now.

    It is unfortunate but totally your fault for not having explained how the visa and I797 thing works to them before the interview. Whatever is the INA that the visa was rejected under, they can still re-apply. Waiting for couple of months is suggested.

      thanks so much....I understand that that's was my mistake I did not explained the is completely. But i heared that if the reason of denial is (221g) you can just submit the missing documents along with passport and then they will decidde if applicant can get the visa or not

      In my case my parents did not get any reason or letter stateing the reason code. and also they did not even put stamp(date) on the back of passort that applicant once got the visa denial.

      Please sugget how do I get the visa denial reason.

        They have stopped putting that stamp many many years ago. Visitor visa denial is always for potential immigrant in 99% of the cases.

            Most VOs give a letter indicating the reason. If it was not given, you cannot find out the reason now.
