    Hi,

    I am in USA on H1B. I want to bring my parents to USA immediately (in next 15-30 days) on visitor visa because of an urgency. Issue is that my tax returns have wrong tax status. Instead of filing as married I have been filing as single and have been paying more tax than what I should have been paying. Is this going to be an issue when for my parents go for the visa?

    If they ask my parents about my marital status, my parents are going to say that I am married and if they look into the tax details they will find out the descrepancy. Do u think this will matter as I have been paying more tax than what I should have and hence tax avoidance is not the intention.

    I will file for an amendment soon but that takes months together to get approved and I can't wait that long.

    Please help.

    They should say you are married and you can file for amendment of your taxes and get money back from IRS.

      Will appreciate if you could ellaborate your response.

      If my parents go for the visa with my old tax papers, do u think it will be a major issue? As they are quite old, I do not want them to travel 500Kms to the consulate just to get their visa application declined.

        Why did you mention wrong marital status in the first place? That is what the consulate may want to know before deciding anything.

          Amend the tax returns and send those papers along with the returns. Anything that is fishy might raise some eyebrows at the consulate. Travel and attending visa is inevitable and being prepared for the outcome is also better as a visa cannot be guaranteed no matter how good the paperwork is.
