  • Can my parents go one by one?

    Please everyone help me. I am too worried.

    My parents have been rejected twice on the basis of overstaying just for few months and that also in 1997. I am the one an only son and on student visa there. Now, they have sound reason for coming to USA.I am so much sick that I need my parents with me otherwise my academics will affected. We have doctor's letters also for that.

    Now, my parents are thinking to try to opt for interview one by one. Means my mom will go first for an interview and then after a week or so my dad will opt for an interview. Does that sound good enough for getting visa? Or they should go together. If they go one by one, will the officer come to know that we have done such trick?

    Officers know every trick in the book.

    Plus, why should your parents be given a visa, if they abused the one they had before?

      They abused the one? Didn't understand.

      Anyways, that's what I am asking. How would officer know the trick? I want to know in detail so that we can plan for our next interview.

        You said they visa has been denied because they overstayed "by a few months". That was then abusing their visa.

        Officers know every trick in the book. They are not going to approved their visa, just because they apply at different times.

        If you are looking for ways to trick and cheat, you are in the wrong place.

          But there was a sound reason behind overstaying at that time. My dad had Hernia and he had severe pain in his stomach. He was been hospitalized but did not take any certificate from the doctor as we did not have any idea that such certificate will be needed sometime in future. And that also remember, the year was 1997 sorry 1996, approx. 12-13 years ago. Now just tell me, why would my parents wants to be an immigrant at the age of 52. He is doing his government business here and have to come back after a short period of time.

          And tell me, how officers will know every trick in the book. Are they God or what?

          The problem is I am seriously sick here that my academics are affected and there might be the case "that I might even leave this world forever". And for that, I need my parents to be here to support me. Now, I don't want to tell you what kind of sickness is that. But I have all American and Indian doctors' certificates describing all that, as I have come to India to take complete treatment. Now in such condition, should the officers look for potential immigrant intent or their urgency to go to US? I am literally crying writing this.

          We are neither here to cheat or trick the officers, I just want my parents to be here. That's it. Now where does the come cheating here? I am just asking that if my mother goes first for interview, atleast if she can be granted visa, I can relieve a bit. If she is denied, my dad can go and try his luck.

          If my parents go together, if they been rejcted visa, both cannot come here and I would be in serious trouble. And if they are granted, that also would be together. So, I just want to know which option should I let them choose?

          I am hating myself for writing so much to explain a person who cannot even understand the matter properly. Where does the cheating come here?

            They are not God, but you are also not the first one to think of this trick of attempting visa separately. They will see through it right away, given your prior history of applications and overstay. And this is tricking/cheating. It may backfire also, and visa may be be outright rejected, so watch out.

            If you have such an urgent case at hand, you may qualify for emergency appointment also. You need to mention in the application the reason, and convey the urgency to the officer during interview.

              No, consulates are not Gods but they do have computerized records.

              If the consulate believes that they are not eligible for a B2 because of their prior record of overstaying I am sure that the consulate has them in their records.

              If you check just this forum you can read so many cases where husbands and wives have applied separately in the hope that they will be able to fool Visa Officers into believing that they are traveling alone.

              So yes, it is a pretty common trick.

              And logically speaking, the fact that they apply separately is not going to erase their record of having previously failed to leave the US on time.

              No point getting over-emotional here. It doesn't help your health nor is it going to get your parents a visitors visa.

              Your parents may have had valid reasons for overstaying but frankly the Consulate is not interested. They can afford to be as strict and tough as they like because there is no shortage of people applying for visitors visas. So it is their way or the highway. Take it as it is or leave.

              If you have a serious health problem you should be able to use all your doctor's letters to apply to your department/University for a planned leave/temporary break of up to a whole year from your studies. Every US university allows you to do that.

              And then try to get back to your home country so your parents can take care of you.
