    Hi,
    My dad came to the US in Aug-2003. Initially he was given a 3 month visitor visa at chennai. Upon entry the immigration officer at the POE gave a 6 month period on his I-94 [Strange, but true!!!].
    So his term will be up in January. As he came thro Frankfurt, and as per the current rule, he should get a transit VISA from a German embassy.
    The question is.
    Is the I-94 status acceptable or should I submit any extra doc/letter explaining the situation?
    Anyone who has charted these waters?.....

    If he has ticket to USA and if he is not getting out of airport, I don't think he requires transit visa to germany.

      Thanks for the reply. I was shut out due to bad health.

      The transit visa is required for passengers without a valid US visa. As in my dad's case his visa was valid for 3 months only but has been able to stay due to his I-94 being valid for 6 months, i think the transit visa is required. I still have not been able to get anyone in the embassy to help me with this. [The airlines asked me to talk to someone in the consulate, but i get the recorded message always when i call the consulate, DC]. Sent an email to them and will go in person next week.

      If anyone else has been thro this earlier, your input will be greatly appreciated.

        Hi,
        Just wanted to update on the latest status. I went to the German embassy in DC and applied for his transit visa and got it stamped. As mentioned earlier, he requires a transit visa in his case [I-94 based stay beyond the Visa period].
        But one important lesson learned from this "adventure". When you submit your required documents, and if you have a sticker on your flight ticket [called flight-coupon]that mentions the changed date of journey, submit only photocopies of those pages to the embassy. If there are additional pages [passenger-coupon] that still contain the old dates, DO NOT SUBMIT those pages. May sound strange, but in my dad's case, they retained those pages from the docs i submitted and printed the wrong date on the VISA.
        Remedy:- Paid another VISA application fee and got a new VISA stamped for the correct date.!!!! >:
