I'm a British citizen from birth. My wife is South African and is currently in the UK with a 2 year spouse visa. My wife's mother is South African. 15 months ago my mother-in-law went on a 2 week holiday to the US on a standard visitor visa (tourist B2). However this was arrange by a church who paid for the flights and wanted her to live with them. She has overstayed her visa and is still living with the head of the church in their house and receiving cash-in-hand payment for looking after the house.
My mother-in-law does not want to leave (yet), we know it should be a 10 year ban if she goes voluntarily. We would like to go visit her. On the DS-156 form there is a question regarding family members in the US. Your site says to be honest and answer yes to this question, but how do I explain that she has overstayed her visit?
We have no intention of staying longer than 2 weeks, and can prove we have jobs and a house to return to in the UK. But we are concern that my wife's visa will either be denied or we shall be forced to give up my mother-in-laws whereabouts. She does not want to stay for ever, but is happy how things are.
Also, the church keep telling us that they are working on her paperwork so that she can stay there legally. I can't see any info anywhere to suggest there is any kind of paperwork about?
