Time frame between 2 visits

[strange pls help]

hi all

My mom has a 5 yr. multiple entry visa. She is right now with me in US. She's planning to leave in jan/feb 2004 & is planning to come back in july/aug. 2004 for my delivery...will there be any problem in her re entry as the gap is short to 5 months....are thier any chances that the immigration officier will screw her & either deny or limit her visa to 3 months...what reasons can she say about her 2nd visit with a very short break.....!!! pls. anybody who had similar problems help me....any input is appreciated...:rolleyes

There is no specific amount of gap that is required between 2 visits. If she needs to come, she can just come. This is so subjective that it is extremely difficult to say anything.

However, one thing is clear that if the person on visitors visa keeps coming to US very often and tries to spend most of his/her time in US, then immigration officer can say that person does not have valid non-immigrant tourist intentions and can deny entry altogether.

One thing she should not say when returning is that it is for your delivery. That looks too much as if she will help you with babysitting, which is not allowed for a tourist.

I myself believe that there would be no problem for you mother to come in for a second visit as long as she did not violate her status on her previous trips.the time period is a indicator for immigrant intentions,but with your explanation she is coming for family reasons and is intending on returning back.

If there is ties and equities relating to her returning home,she should have no problem at all.babysitting in itself is not an issue really in a situation like yours.

The only problem i have is if your mother is told to lie about her intent to look after your child after delivery.if she states that to the officer she is not and it could be found out through various means that she is infact babysitting,she could be refused or barred from the U.S. for misrepresentation.

Therefore i suggest not to lie and for her to be straightforward on her intentions and i believe she should not have a problem at all

Of course, she should not lie. But the main thing is that she is not allowed to do babysitting and the like. If she does, she could be in trouble later on.
The usual thing is to not lie, but not volunteer information. For example, if she in fact is, at least for a certain amount of time, sightseeing, she would not lie if she says so when asked at the POE. She does not have to say that her daughter is pregnant, unless of course she gets asked. A lot of people get busted because they are too talkative and tell the inspector a lot of things he didn't even ask about. And of course, the inspectors are trained to get people to talk...

So the simple rule is, truthfully answer the questions the inspector asks, but don't tell them anything they didn't ask for.
