  • Indian Passport with USA visa stolen in USA

    Hi All,

My mother came to USA this year with 10 year USA visa. (visitor visa).
She got 6 months stamp at the POE. Her return ticket is booked well before the date stamped. So she will be returning to India in time.

After coming here, while traveling , her purse containing passport was stolen.
We immeidately filed police report and we have a copy of it.
We have an old passport copy which has the copy of her USA visa.
Passport also had her I-94. Unfortunately we did not make a copy of her i-94 or passport page with the stamp that she got at POE.

We applied to Indian consulate for new passport. And we got one.

I have questions about her visa and i-94.

    1) USA visa -

    a) How can we notify USA authorities about stolen passport and visa?
    b) What is the procedure for getting USA visa stamped again? Will she have to go thr the whole visa process again when she returns to India?

    2) i-94 -

As I understand, she will have to fill i-102 if she wants new i-94.
The fees is high also she may not get new i-94 in time before she returns to India.
    a) Will she have any problem while leaving USA if she has no i-94?
She does not have any proof of her entry to USA currently. As we did not make a copy of i-94.

    b) If not, will it have any negative impact if she comes to USA ever again?
This because they will not have any record of her leaving USA.

    c) I sponsored her. She lost i-94. Now if I ever sponsor my any other relative, will this case be a problem in obtaining visa for them?

Has anybody gone thr similar experience?
Any help in this matter is appreciated.

    Thanks.

She has to go through the same stamping process all over again. Let her maintain a record of her departure with proof of leaving the country, boarding pass etc. I-94 return at exit closes the record of entry without which it would likely look like your mom overstayed.

Apply for a replacement I-94. If you want the number, go to POE and they may be able to look it up with her visa number if you have a copy of it.

Once you get the I-94, return it along with her proof of departure to the address in London, Kentucky. Details are on immihelp.

She will not have trouble leaving the country but make sure the flight itinerary is through a country that does not need a transit visa or a valid US visa. She will have trouble re-entering again or getting a visa if the record of entry is not closed with the corresponding departure record.

No, other relatives will not be impacted due to this.

      Thanks for the information.
My problem is what if my mom applies for new i-94 by filling i-102 and it does not arrrive in time (before her date of USA departure.) Will she have any problem leaving USA without i-94 ?

      Thanks.

It has been answered "No" earlier.
