  • Need some clarification on my father-in-laws visit

    My FIL visited us in April 2008 and gave a 6 months stamping. We applied for his extension and it was approved and he left on the 15th Jan 2009.

    I would like to know if he can travel in the middle of this month for about two months stay here in the US. He has a ten year multiple entry visa.

    I know that one can stay for 6 months in a year rule. But if anyone has any inputs to provide, it would be very helpful.

    If the person tries to stay too much in the US, he may not be considered tourist and he may have trouble entering the US.

      Can you please be more specific. Everybody knows that we should not abuse the system.
      I would like to know if it is possible or not. He has already been here from 5 Apr 2008 to Jan 15 2009 which is about nine and a half months. The rule says 6 months every year - when does the year start and end. This time, if he comes, he will be staying for 2 months only. So we plan to only ask for 2 months during i-94 stamping.

      Legally can he come now.

        There is no rule as such. It is advisable that the person spend at least double the time spent in the US outside in their country before they return.

        They could be given a short duration I-94 on the next visit.
