  • US Visitor visa ineligibility under Section 221(g)

    Hi,

I am inviting my parents and my sister to USA for my marriage.

All three of them had valid visitor visas for the USA which expired on October 2003. Last year my mother and my sister traveled to USA on their visitor visas for one month.

On July 1, all three of them applied for visitor visas through drop box. They did not get visas under Section 221(g). We had supplied all the required documents. The consular has asked them to appear in person for visa. They are planning to appear in person. We would be grateful to you if you could clarify certain things.

    1) Do they have to fill the visa application form (DS 156) again?

    2) If they have to fill DS 156 then what is the correct answer to the question # 31 in DS 156.

    31. Have You Ever Been Refused a U.S. Visa?

Please note that their visas were never rejected before. The last application was rejected under section 221(g).

    3) Do they have to get an appointment through Visa Facilitation Service Center? Or Can we walk in at US consulate office in Mumbai at any day?

Thanking you for your time and consideration. Waiting for your reply.

Thanks to immihelp for helping us free of charge.

    Sincerely,

    Patel

      Updates on 221(g)

      Hi,

My parents and sister got 10 year multiple entry visitor visa at Mumbai Consulate.

The following information is with respect to the above mentioned questions and is useful for the applicants who have been requested to appear in person under section 221(g) at Mumbai consulate.

I had sent an e-mail asking above mentioned questions to the following addresses.

      [email protected]
      [email protected]

Based on their replies and our experience, we have following information to share with you. Please note we had applied for visitor visas through drop box. We were told to appear in person in a letter that stated visa ineligibility under section 221(g). Our passports were returned with a stamp on the last page.

      1) We were not required to take an appointment through VFS. We were told to appear at the consulate office any business day at 10.30 am.

      2) We were not required to fill DS 156 again. The old DS 156 that we had supplied with our application at the time of drop box application was still valid.

      3) We were not required to pay the application fees again. Note that we had paid visa application fees at the time of drop box application. We were told to carry only visa issuance fee drafts with us.

      3) From above 1, 2 and 3 we have concluded that visa rejection under section 221(g) is not actually "rejection". It is visa ineligibility. It means the consular is unable to determine the outcome of the visa application at that time. The possible reasons are, missing documents or personal appearance required.

      4) We were told to collect our passports at the consulate office the next day. This follows from the fact that the logistic fees paid at the time of drop box application had been used for delivering the passports. They will not deliver the passports twice for the fees we paid. Also note that VFS at Mumbai will not provide any service since we did not have an appointment. If you want service then you have to purchase tickets.

      I wish above information helps.

Also for those folks who are trying visas for their siblings.

My sister is young, unmarried and medical student. She still manage to got 10 years multiple entry visas along with my parents. I know it is hard to get visitors visas for young people but as in her case, its not impossible. One has to prepare all the documents very well and answer all the questions in a convincing manner with full confidence.

For documentation, immihelp is very useful and thanks to immihelp team.

      Good luck,
      Take care,
      Patel

        - What special preparation did you do ?
        - Which documents did you provide ?
        - Which documents did your sister provide ?
        - What questions were she asked or did you prepare her for ?
        - What did you specify as a reason for her visit (for what duration ?)

My brother is manager in national bank and my sister is also working
in a local firm. They will be visiting for a month

My parents already has 10 yr multiple entry visa and they had visited me in 2000 for 2 months and will be accompanying them if they all get the visa.
