  • I-94 problem

    I am on H1B visa and will be visiting India for a short vacation soon. I am planning to bring my parents back with me to USA on Visitor’s visa.

    When I come back to USA (within a month), I will have a new I-94 document. If I send all documents required for seeking Visitor’s visa to my parents now, (as this will have my current I-94 copy), will my parents have problem in seeking visa?

    Coz by the time, they get an interview date (Mumbai consulate) and go for an interview, I may be in India or if in USA, I will most probably have new I-94.

    Will this be an issue? Please suggest.

      Not a problem

      I-94 is not needed as part of the documents submitted by sponsor (you).

      Even if you want to send it, the original is not needed. So, if you come here before your parents, you can fax them a copy of I-94.

        I-94 problem

        The documents for Visa sent by Sponsor says that i have to send copies of "all sheets in my passport" and I-94 has become an integral part of it. So i have to send a copy of my current I-94.
        Now, when i leave USA for a vacation, i will have to surrender my current I-94.
        What if... i am in India at the time of their interview?
        I will not have my current I-94 document.
        If the consulate runs a check on my current status in USA, they may not find it.
        Will this be considered illllegal??

          No

          When you apply for your parents when you are in India, you will not have your i-94. That is why I said I-94 is not required.

          When you surrender your I-94 at the US airport, the system will be updated and people in consulate will know that you left US. This is not illegal.

            Again, don't worry. That is not a problem. Consular officers understand the procedures very well and different circumstances that people may be in.
