Can I sponsor for visitor visa when my H1 is going to expire in 4 mons

Hi!

I want to sponsor visitor visa for my Mother-in-law.
I am on H1 and my visa will expire in feb 2010.I am going to apply for the renewal.I want my mother-in-law to come in Jan.We have taken visitor visa appt for oct 22 .Will this be a problem?
