  • Please suggest me how to correct my mistake on visitor visa

    Anyone please suggest me what to do.
    I know this is a long post, thanks in advance for reading the post.


    I and my husband both are on H1.We applied visitor visa for my parents. My brother-in-law (Green Card holder) sponsored them for the visa, we did not sponsor them because I was on H1 and not in a project and do not have the paystubs. We thought Visa Officer would ask anything about my status even if my husband send them the papers and VO would reject the visa asking about my status.

    While filling the DS 156 form we mentioned that there are no children in USA as my brother-in-law is sponsoring them and if we mention about me in 156, VO may ask why your daughter is not sponsoring for the visa. So we did not mention about me.
    As I have my husbands last name in my passport we thought VO may not find out about me that I am in USA.

    My parents applied for the visitor visa twice and got rejected on 214(b).They have strong ties and enough property in India.
    My father is a businessman and mother is in politics elected as a mandal president (president for 52 villages).

    First time (Applied in July): Both my parents attend the interview
    1. What do you do for my mother and father?
    2. How many children do you have?
    Answer: One daughter married and living in India.
    3. Who is there in USA and what does he do?
    Answer: They were confused about the client name of my brother-in-law and could not answer that question correctly.
    VO rejected the visa on 214(b) and we thought they were not able to answer the client name and got rejected and if they prepare well for the second time they would get the visa.
    Second time (Applied in August): this time they prepared well and answered all the questions perfectly.
    They got rejected on 214(b).Don’t know the reason for the rejection.

    Third time (Applied in October): This time I applied for my mother only as my father is in India so that would be a strong tie and would get the visa approved.
    Still got rejected on 214(b) asking why you are going to USA alone.

    Anyone please suggest me what to do now.
    Is there a way that I can correct my mistake in 156 form mentioning that I am in USA and sponsoring them form me for the visa. If there is a chance please let me know.

    You should never lie. I don't understand why they said you are in India, when you aer in USA.

    They can try again. However, make sure that everything is absolutely truthful.

      Thanks for your reply.

      If I reapply next time and they sponsor themselves can I mention that I am in USA and send them the invitation letter.

      If I mention that I am in USA at that time will there be any problem to their visa like completely ending up not entering in to USA for lying last three times.

      As my parents got rejected on 214(b),do you think did Visa Officer find out about me. If VO find out about me or not how can we know.

          Obviously, Visa officer knows that you are in the US. That could be the primary reason for their rejection.

          As I said before, tell everything truthfully, apply again and hope for the best.
