  • visitor to work visa

My mom have a visitor visa for 10 years. i would like to have her stay with me for a 3-4 years strait as a nanny.
1- Can i apply for a work visa for her. As a nanny who can teach my kids my native language and culture?
2-And if so is it better to apply from here the US or from overseas?
3-How long the work visa will be for?
4- If denied would she looses her tourist visa?

Thank you so much for the advice.

This is exactly what US Embassy does not want you to do

I think you should ask this question to an attorney or in some other forum. Not to offend you, but this kind of question irks people who could not get the visa with a genuine intent of visiting their children and grand children...

      Yeah, that is true.
Just out of curiosity, what visa are you on? I don't think it is possible for you to apply for a work permit (that too for a nanny), especially if you are on a work permit (h1b or similar) yourself..
I remember reading a similar thread in this forum (must be in the archives now) where somebody had suggested an au pair visa but turns out that is only for a certain age group.
If you were a citizen, you could have sponsored a green card for your Mom; other than that I can't really see how you can get her to stay that long..
ah well, that is what we have lawyers for! Maybe an immigration lawyer will be able to help you better, but I really doubt it because if it was doable, lots of people would have already done it.

        Re

Nanny visas are possible, even for somebody on H1. But, that requires that the person worked as nanny for the family even in their home country.
        So, it wouldn't work here.

I also see no way this would work.

And, as a final note, if your mom is babysitting or acting as nanny while she is here on a visitor visa, she can get into trouble. A visitor visa is for tourism, not for helping in the household, even if it is her own family.
        People got rejected for that.
