Possible for husband to reenter US under b-2

I married my husband in US in March 09, he came under VWP. We failed to file for his green card and he over stayed his 90 day passport. We found that if he left before 180 days after his 90 days then he would not be prohibited to return. We have no pending applications for permanent residence. He left the US two weeks ago and returned to London, England. He has filed for a B-2visa to return to the US for the birth of our child in January. Is anyone aware of the possibility he may be approved to return to the US considering he has not filed for permanent residence?
