I am on H1B and my wife is on H4. She is going to complete her masters and has grad walk in December 09. We would like to invite our parents to her grad walk.
My H1b expires on November 19th (140 approved) and I have applied for extension on September 8th and I am waiting for approval. Could we still go ahead with visa process?
Option1:
Send them the letter from the school and ask them to attend the visitor’s visa interview in Hyderabad.
==The downside to this is, my H1B expires in Nov and will the consulate in Hyderabad look at this as an issue or will they understand that 140 is approved and I will get my h1B extended, which I have already applied (will send the respective papers).
Or
Option2:
My brother is a US citizen, can he sponsor for a visitor’s visa for them, next year he is planning to apply for the green card for both the parents so not sure if the visitor’s visa will help the process or will hurt the green card process.
My parents are planning to be here not more than 15 days.
Can someone let me know which is a better option.
