My parents visitor visa got rejected twice at the Mumbai Consulate at their Gujrati section. The first time they applied was through me in Jan 2004 for 6 months and the second time through my brother, who is a student and graduating this month in May 2004. The second time parents said they will be visiting us for 2 months only.
The reason for refusal the first time was:
(I have 2 brothers and myself in USA and in Jan my parents had not taken sufficient documents to prove their return back to India ....docs like property papers, business documents etc.)
1. "Since all your children are in USA you may not return back to India"
Q's asked the first time:
1. What is your daughter doing in USA?
-Married and working
2. When did she complete her graduation
-May 2003
3. Which University
-Arizona State University
4. Do you have any other children in US?
-Yes 2 other sons. One a student and the other working in California.
Thats it and the visa was rejected.
So..
The second time we decided to call them through my brother mainly to attend his graduation ceremony in May 2004.
My parents were well prepared this time. They had taken all their necessary business, property papers and also shown proof of taking care of my grandfather who is 90+ yrs of age and totally dependant on us plus proof that their younger son is getting married in Dec 2004 and they need to return back for the wedding preps.
However this time too they got rejected on the basis on this question:
1. "Previously you mentioned that you want to visit US for 6 months and now you are saying that you want to visit for 2 months. Why is this so?"
-My father replied with all possible reasons like business, dependant father and pending marriage making it impossible to stay beyond 2 months.
But the officer simply refused to listen and send them back with a rejected visa application.
No other questions were asked.
I would be very grateful to anyone who can advise me what I should do now and when is it a good time to apply again for parents?
Sometimes I think we should appeal immidiately as the reason for refusal based on the period of intended stay is NOT a fair assessment as it entirely depends upon the applicant to specify his/hers period of stay and consequently a strong point of argument.
I am at present totally confused and in doubt of what my next actions should be.
Any help from anyone will be highly appreciated.
