    To whom it may concern:
     
    My 78 year old father went to the American Consulate in Rio de Janeiro on November 30th 2009 for an interview for issuance of a tourist visa. He was hopeful to spend the Christmas Holidays with his grandchildren and the visa was denied. A visa was granted to my father in 1999 but circumstances at the time prevented him from traveling to the US. My father is retired, does not own any property, a business, nor does he have enough income to prove to the Consulate that he has strong ties to Brazil, however; he does have children, grandchildren and all of his immediate family living in Brazil and he considers that to be strong ties and enough reason to return to Brazil. My husband and I are both American Citizens and we had gathered documents to be presented to the consular officer indicating that we would be responsible for his return to Brazil after the holidays. We had form I-134 (affidavit of Support), letter of invitation from us to my father, letter to the American Consulate requesting a visa and attesting that we would be responsible for all of my father’s financial needs and his return to Brazil on the date indicated on his airline ticket. We also included our employment and income verification letter from our employer, pay stubs and our 2008 income tax return. My father called me after the interview and told me that the consulate officer did not look at any of the documents presented to him and the officer left the room and returned with the denial letter. I understand that an invitation letter and an affidavit of support from us does not guarantee issuance of a visa and that the applicant is the one responsible to prove that their status has changed. How can an applicant prove that his/her status has changed if the consular officer does not look at the documents presented to him/her? How can the officer that interviewed my father know that my father is worthy or not of the visa if the officer disregarded the entire interview? I could apply for an immigrant visa for my father as I did for my mother, however; my father’s intentions are not to live in the US but to spend Christmas with his daughter, son-in law and his grandchildren. I have sent the Consulate this letter and have the reply from them and it is no answer to me. I was just wondering if there is any advise you could give about my case.
