  • USA visitor visa for my step mom

    Hello,

My father married my mom. As my mom did not have children for 12 years, he married my step mom(my mother's sister).
Currently i am in U.S and i want to bring my father, mother and step mother to US on Visitor's visa.

Please advise how i can bring my step mother.

    -TIA.

Who is your real mom in that case?

The lady whom your father got married first, or the second?

Did you father divorce first wife before getting married to second one?

My father's first wife is my mom.
No he didn't divorce when he married my mom's sister.
My mom 68 and her sister(my step mom is 58).

In 1960's i don't know whether there was such a law, that he had to divorce.

Unless your father is Muslim, your father is not allowed to have more than 1 wife at a time. That was true even in 1960s.

Your father is going to be in big mess if he declares anywhere that he has two wives.

The two people whose names are in your passport under the heading of 'Father' and "Mother' and in your birth certificate will be regarded as your parents.

You will have to provide a copy of your passport and your original birth certificate when you sponsor your parents.

I take it that your father's second marriage was not registered since he did not legally divorce his first wife. So that second marriage is not considered as legal and does not exist in the eyes of the law.

Hence, you will be able to sponsor your mother's sister as being related to you NOT as your step mom but only as your maternal aunt. To sponsor her, your aunt will have to provide legal proof of her relationship to your mother and through her to you (if they are blood sisters).

It would be better if your other relationship with her (i.e. as your step mother) is not even mentioned in the application if there is no legal validity to the second marriage.

            Thanks for your inputs!

Can you advise in my step mom's DS-156,what should be mentioned in Spouse name ,Spouse DOB column fields . Can we leave them blank? But again, they might ask , whether she is married, she has to say 'Yes'.

So, i don't know what to do here.

Your inputs/advices will be of great help!
