B2 visa rejection/ineligibility

Hi All,

I had applied for a B2 visa from India. I wanted to travel US as my wife was staying in US(working in H1B visa). When I booked the appointment and went for stamping, the immigration officer in the counter, after verifying all my documents, told me the visa can't be given because my wife already there and I can apply for H4. They did not give any documents to me.

I am not sure if this is a case of being ineligible or rejection?

Right now I only have the respective DS160 with me. Is there a way to check the case status ?

It was expected. One of the first basic requirement for getting a B2 visa is that you need to have strong ties to your home country & in no manner have any plans/intention to stay in USA longer. Having a spouse in USA on a long term visa makes you ineligible for the same.

Apply for H4.

Hi thanks for the reply. I am not sure if this is a case of ineligible or rejection. Now I am going to apply for H1B and there is a question in DS160 that if I had any rejection in any category in the past?

Do I need to mention that as "yes" considering the B2 rejection case happened to me ? Because I am not sure if this was a rejection because they did not give me nay documents ? Usually in case of nay rejection do they give a document to the candidate ?
