B2 Visa rules - for Brother & Sister in Law

    Hi All,

I would like to bring my elder brother, sister in law and niece for a USA visit in tourism purpose. I have a few questions need to be clarified

    1. My brother already has a valid visa stamped as B1/B2. By definition B2 is tourist visa - so does he need to get a new visa again? Or he can reuse the same?
    2. In case my brother can reuse the visa - do I need to send a I-134 form for him too or it would be only for my sister in law & niece who requires visa?
    3. In case my brother can reuse the visa - do I need send invitation letter for him too? I guess if does not require new visa - he wont require a consulate letter.
    4. In case my brother can reuse the B2 visa - does he need to fill up DS160 again? I guess not - as he is not appearing for visa anyway. Please confirm.
    5. I do not have a govt issued date of birth certificate - in that case can I use other govt issues documents where my date of birth is mentioned? Like my school 10th certificate etc?
    6. Can I sponsor my brother, sister in law & niece at all or do they need to apply for their own? I heard somewhere that you can only sponsor your parents and no-one else - but not sure if thats true or not.

Sorry for multiple questions. But it would be really helpful for me as I am very much confused.

    Thanks to all in anticipation.

    Regards,
    Shubhadip

    1. Not needed.
2 & 3. Send the documents only for the rest of the family who is applying for visa.
    4. Not for him.
    5. It is required. Read https://www.immihelp.com/birth-certificate-for-us-immigration-and-visas/
    6. There is no such rule. You can sponsor anyone, including those who are not related to you, such as friends. God knows which web sites are spreading such rumors.

Thanks a lot to immihelp support team. I mistakenly posted my post in B1 forum and could not change the forum - so posted again in B2. Sorry for that.

I have just one more question regarding the birth certificate. In India lot of cases are there where birth certificate was not available due to multiple reasons. Same is with me. So in this case is there no way out to apply for a visa for my relatives? No other document which proves my birth date can be used?

    Another clarification against
"In case my brother can reuse the visa - do I need send invitation letter for him too?" - Dont I require to send invitation letter to my brother? I thought this would be required even though he has a visa?

Thanks again - for so prompt help.

    Regards,
    Shubhadip

        Need help! In similar situation

        Hi Immihelp

Sorry to reply on an old thread but needs some advise here. I am in similar situation but my questions are bit different.

My case: My sister has a valid B2 stamp which she got before getting married. I did not sponsor her Visa but my Uncle did who is a citizen here. Now I a sponsoring my Brother-in-law's visa but both of them would be visiting here.
Reading the instructions here. In I-134, I mentioned that he is married but did not provide any spouse details as only he is applying for Visa. Also I prepared Invitation letter and Letter to Consulate only for him.

        Now the question is
        1. In DS-160, there's a question on Travelling companion. should he say Yes and provide my sister details or NO ?
        2. If he says YES, and provide my sister's details, should I mention spouse details in his I-134 and also include her in the Invitation letter as I will be sponsoring both of them ?

The reason I'm asking is because if I don't include my sister in Invitation letter then they might question who is sponsoring her travel as I have invited only my Brother-in-law.

        Please help.
