  • visitor visa, have immigrant petition approved

returned home to apply for consular processing of my employment-based immigrant petition. my father who holds a green card, is now seriously ill in the US and i can't wait for the consular processing. what are my chances of getting a visitor visa when i have been already approved for immigration and how can i get it speedily? can i jump any queues based on compassionate grounds? please advise, am very worried.

How long do you think it may take before you are done with consular processing?

What about your current on which you were in US, such as L1, H1? Is that already expired? If yes, how were you working in US, on EAD? If yes, did you get Advance Parole? If yes, use that. If not, use unexpired L1, H1 to enter US.

Visitors visa would be very difficult to get as you have already shown immigrant intent. It may be possible to get faster appointment if justified enough on humanitarian grounds. Check with VFS or TTS on this.

      approved immigrant petition, visitor visa

to administrator: thanks for yr prompt reply.
my work visa expired. i never had EAD. I haven't started the consular processing application as yet. How long does that take? i understand it may be as long as 6 months which is why i worry my father may not live that long, hence the visitor visa.
also what is VFS? and although you say it is difficult for me to get a visitor visa, is it impossible?

I assume you have already finished labor certification and I-140 stages in greencard processing.

Consular processing may take several months.

You may want to at least try to apply for visitor visa and explain the situation to them.

VFS = Visa Facilitation Services. US consulate in Mumbai has outsourced lot of work like appointment, delivery of passport etc. to them.
TTS is for other 3 consulates in India.
Read https://www.immihelp.com/usa-visas/visitor for more details on that.
