    Hi,

    I have a doubt, not sure if it is a right thing to ask you through e-mail.

    My mother has a 10 year B1/B2 valid visa with multiple entry. I work in US, so she visited me and stayed with me for about 176 days, she left 4 days before her I-94 expires. Now after 2 months, I am planning to call her again because she is alone there in India.

    I am just wondering if there is any restriction for her to come again to US because she had already spent 6 months here and then after 2-3 months she will be coming again. Secondly, what if the immigration officer gave her a very less time to stay because I am planning to call her for atleast 3-4 months.

    If she is trying to stay in the US most of the times, that is not allowed on visitors visa. She will face problems and may be denied entry into the US.

      The fact that she is alone in India is not a good reason for her to be spending 9 or 10 months a year in the US.

      If you want a long term stay for her then you need to become a citizen and then file an immigrant application for her.

      She is definitely going to be asked tough questions at the Point of Entry about the reasons for her quick return. If the immigration officers are not convinced by her reasons then she will be granted a shorter stay. And then applying for extensions will not help. There have been cases where very frequent visitors have been denied entry into the country and sent back from the airport itself without being allowed to meet their families in the US.

      She has a visitor visa and to qualify as a visitor to the US she needs to spend more time in her home country than in the US.
