  • Question on visitor visa for Parents and younger brother / intended length of stay

    Hello,
    I am filling up the DS-160 for my parents and my younger brother in India. Planning to have them over for a couple months to spend time together -
    Couple questions and your advice is greatly appreciated -
    1.My father is a voice artist and doesn't work for one particular company nor has a monthly pay check. How to fill in his employer and salary details?
    2.My younger brother is in mid 20's, dropped out in secondary school since academics was not his thing, currently a student in a music school learning instrumental music. Does the ties to his music school good enough to show he doesn't have an intent to migrate?
    3.What is the best length of stay to mention in DS160 for all the three, right now I mentioned it as 2 months which is the actual plan anyway.

    No more than 4 weeks. COUPLE OF MONTHS IS A NO NO. No one visits anywhere for MONTHS unless they have other intentions; in the American case - IMMIGRATION INTENTION. That's what the Law tells Consulars.

    I wouldn't let the Embassy know through the DS-160 about that whole 'doesn't work for one particular company, nor has a pay check'. Those are grounds for denial.

      I don't see any problem in visiting the US for 2 months. Even 6 months is fine. USA is a very large country and it takes time to visit many tourist places around the country. Apart from that, visiting the US to spend time with the family is also a legitimate purpose.

      1. Self-Employed. Estimate monthly income and write it.
      2. It would hard to get visa for him.
      3. Whatever is the real intended duration is what they should put and be ready to justify why that duration.

        The job of the Consular Officer is to interpret U.S Immigration law that relates to NON-IMMIGRANT visa. As of 1952, the benefit of doubt lies with the applicant to prove s/he is not an INTENDING IMMIGRANT.
        If you want to go to the U.S even for 2 days, your visa will be issued for 2, 5 or 10 years depending on country. At the port of entry, you'll be granted a maximum of 6 months.
        I'll tell you for free as a former Department of State employee, if you fill out a visa application stating you are going for TOURISM for 2 months, what you just told the Consular is you have nothing going on for you in your home country and America does not like THAT. Things have changed it is not 2008 anymore. This is TRUMP ERA.
