    Hi,

    I am in a very weird situation. I was in US till June 09 on H-1b visa. I got pregnant and returned to India for delivery. I plan to return to US this April with my son where my husband currently resides.

    My employer is ready to take me back on H-1B visa but I need couple of months before I join back work in the US. So, I have decided to go back to US on H4 visa as a dependent of my husband and then later apply for Change of Status.

    I would like my parents to travel with me on Visitor's visa as it would be difficult for me to manage my infant son alone. But that is the not the only reason though. I really want my parents to visit US and visit a few places as they have not visited US even once.

    My parents have their Visa interview coming up in April. I have my H4 interview the next day after my parents' interview.

    My questions are :-

    1. Is there a problem if the invite letter is from my husband and not me? Or is it a good idea for me to sign the invite letter as well?

    2. Is it a problem if my parents reveal during the interview that they are escorting me and my son back to US? I have asked them to tell the consular officer that the primary reason is for sight seeing. But the question of my current residence will arise and I do not have an I-94 with me in my passport. So, at some point my parents will have to tell the officer that I was here to have the baby and I plan to return on H4 and that we are traveling together. Is there a chance that their visas will be rejected if they know that they are traveling with me and the baby? My son is now 5-month old.

    Is there a way I can reduce the probability of visa rejection?

    Any help and information is much appreciated.

    2. They can say that all of you will be going to the US together. If asked about your whereabouts, they have to tell the truth.
