My wife (we married last week in Mexico), a Mexican national has a 10 year B2 Visa.
Through out this last year she has made 3 or 4 visits to the US, always admitted for 6 months, never stayed longer than 4 months, has not worked etc. etc. During this time we made one trip to Canada to visit her brother.
We returned from honeymoon this weekend, and she was questioned upon entry, initially denied entry, then granted an I-94 for two weeks, following a review of her travel itinerary.
I am a permanent US resident (since December 2000), I plan to apply for citizenship next year. We had received advice that the best approach to take, was to apply for permanent residency for my wife following my application for Citizenship.
Following last weeks entry issues, we are now desperately concerned that she will be refused entry when we had planned for her return mid Jan (we are heading to Mexico for the Christmas holidays.
What if any action can we take or what options do we have to insure that she can re-enter the US?
