  • GC Holder, Visitor Visa for Wife

    Hello,

I have Green Card since Jul/2004. I married in Feb/2006 and am trying to have my wife visit USA for a few months (just for doing some sightseeing together).

Most recently, my wife applied for Visitor Visa (B2) on Apr/27/2010 and application was rejected on grounds of non-eligibility (consular officer cited rule No. 214b - he said Green Card holder's wife is not eligible to apply for visitor visa).

Earlier Oct/2006 she had tried for H-1B visa in and was declined on the grounds that she did not have 4 years of post-high school education.

I work from home in India for my US employer and have been maintaining my Green Card status so far by making intermittent trips to the US. Then applied for 2-year travel permit which is valid from Aug/08-Aug/10. My last entry into India was in Dec/2007 and I am here in India since then.

I will appreciate any recommendations/ideas/suggestions on how to proceed. All we really want is for my wife to visit for a few months. A couple of options I am considering:

    1. re-enter US, stay for 3-6 months and apply for citizenship (I should be eligible) and sponsor a green card for her
    2. give up my green card and apply for B1 business visa

I am apperhensive about both options, especially #2 because if I am denied a B1, my job could be at stake.

    Many thanks in advance.
