  • Melbourne - US B1 visa rejected 3rd time and I need to meet my brother urgently

    Hi,

I am a Pakistani national living in Melbourne, Australia. I am here on a work visa since August 2019 and I am making a good 6 figures. I work for a fortune 500 company as a consultant. I am married and have a 2 year old son who are living with me in Australia.

I applied twice before I got married (2014 & 2016 from Pakistan) and got refused that I do not qualify. I was okay as I was single and had an okay job.

My travel history: 4 previous US trips when I was a teenager (never stayed more than 2 months), went to Malaysia and Turkey for tourism. Traveled to Australia in 2019 twice and currently living here.

I just wanted to meet my brother who is a US citizen and suffering a fatal disease. I wanted to go for a week. To make my ties stronger, I did not apply for my wife or son so they can stay back here. What more ties can I probably show?

The visa officer said that I have been in Australia for just 5 months so I need to wait for my status to change and apply later.

Please suggest is there anything I can do? Should I apply from Australia or should I try from Pakistan?

Here is what the VO asked:
    1. He asked if my middle name was "Ahmed". (It's not and not mentioned in my passport. Not sure why he asked)
    2. Asked how did I get visas in 2005 and 2007
    3. Asked the status of my brother? (He is a US citizen)
    4. Asked how he became a US citizen (Told him that he came as a student 20 years ago and went through H1 route)
    5. Asked where I work and how long I have been in Australia?
    6. Asked how long I want to stay there (told 1 week)

You are from Pakistan, but living in Australia for last 5 months, so right now, neither you have ties to Pakistan, nor with Australia. As VO mentioned, you need to stay in Australia for some more time & change your status to PR/Citizen, before applying for visa from Australia. Or else return to Pakistan & apply from Pakistan.

Probably he saw some other profile matching your name and middle name as "Ahmed" & wanted to confirm if you are that person.

Probably he want to ensure if your brother used a legal way to become citizen or some other way.

This is where he checked, if you have sufficient ties to Australia or not.
