What’s the worst that can happen? I’m on the edge of turning in a visa overstay.

My brother has a psycho woman that got pregnant and has had the baby. She has overstayed her visa by 3 years. He has her living in his house so he can see the child every day. The situation is beyond horrible. I want to turn her in, the child is us citizen, she would eventually come up on their list and get picked up and deported. Thing is, his attorney said for him (or any of his friends or relatives) to not report her. Says it would be bad for him to do so.

I can’t stand what she is doing to him anymore. It’s too long a story but humor me here, no judgment please. Suffice it to say that she is mentally and verbally abusive to the child. I want her gone, we all do but Im the only one with balls to do it.

what is the worst thing that can happen? I mean, he IS the father, the child has no passport and was born here. How could this affect my brother’s future rights as a father? The attorney didn’t elaborate and my brother failed to ask. From the way I see it since it has been over six months she would have to stay out of the country for 10 years. That would at least allow my brother to raise the child in a peaceful loving nurturing environment until he was a young teen.

Does anyone have any idea what’s the worst that can happen?

I don't think anything worst for your brother - he can simple refuse that he didn't knew anything about her legal status or that she was staying is USA illegally, etc.

Since the kid is a citizen, your brother gets equal rights to keep him with himself & she would be asked to leave the country.

However, she can apply for her own GC under VAWA act & then stay in USA forever & that might become a problem for your brother.
