Visitor visa for sister(about to be divorced) and nephew

    Hi ! I am currently on H1B and I would like my sister and her kid (6 years old) to the US on visitor’s visa. Sister is currently separated, have filed for divorce, the first hearing of which would happen during March. Considering the nature of sister’s husband, I am not sure if we would be willing to sign consent letter to send the kid to the US. Sister doesn’t earn much and doesn’t own any property. I would be sponsoring them for their expenses and stay.

    Please advise how i can avail B1/B2 visa for them considering the situation. Would they face any issues during the interview considering the absence of the father?

    Any help would be greatly appreciated

    Considering the absence of father isn't that problematic, she can mention that she is separated in her DS160.

    However no income, no property would be a bigger concern.

    She need to prove strong ties to home country to get the visa.

      Thanks for your response. She has availed employment verification and leave letter from her supervisor and HR. She will also be taking bank account savings letter from bank manager. Would those be strong enough?

        Employment verification & leave letter doesn't have high impact - she can leave the job once she get the visa.

        So she need to prove that her intention is not to remain & live in USA - some property in her name would be a better, compared to saving account.

          Thanks for the response ! She doesn't have any property. She would be requesting for a month's time in the US during her kid's summer vacation. Could you please suggest what else we can show as proof for her ties with India?
