    Dear all,

    Thank you for you help!

    Follow my case,

    During my visit to the USA as B1/B2 visa holder, I´ve applied for a extension of stay. The entire proccess took around 9 months until I get an answer, and it was a DENIAL. After receive the letter, I left the country at the same month, not acquiring illegal presence. Of course my visa got cancelled and at my home country, to ensure a new visa I tried to reapply 5 months later, after leave the US. The visa was denied according to INA 214B and the consular officer politely gave me a reason: "just 5 months you came back, you don´t have enough ties to your country, I suggest you to reapply later after you situation has improved". She read my extension denial letter and didn´t say nothing about it. In fact my extension request was denied by my own mistakes, since I made it by myself. Today 1.5 years after my last attemptive get denied I intend to reapply for an F1 visa, I´m trying my TOEFL english certification. According to my case, can you give me "a light" in how to procceed to be more assertive and overcome this denial situation and also, what are my chances to get a new visa?

    Did you get Student visa?
    Regarding your question, Since both visas are in different purpose, you will have to clearly demonstrate your purpose of visa. But, both visas you are going to apply and already applied is under Non immigrant category.
    So, I hope you might have tough interview.

      let me guess...the first time you applied for and received your B2 visa, you told the CO you were going to visit for 2-3 weeks, not several months...which means you quit your job after getting the visa and likely worked illegally in the US (and applied for an extension to continue doing so)...now you 'need' to study English? doubtful....your credibility has been ruined by the fibs and your actions the last time, so why would another CO trust you?
