  • Visitor visa denied for sister & brother-in-law

    Hello,

My sister and brother-in-law appeared in an interview at Mumbai for visitor visa. Unfortunately, their visa was denied after asking multiple questions.

Background: I am (brother) in USA for last 12 years (MS+H1B visa**40 approved). Wife on H4. Mother-Father have visitor visa but never visited USA. Sister employed in a govt bank. Brother-in-law is a business man. He studied and worked in Canada. He got Canada PR and then moved to India for good.

Questions asked to my sister and brother-in law:

    Sister:
    1) Who stay in USA and whom are you visiting?
    Answer: Brother
    2) Where does your brother stay?
    Answer: Replied with address.
    3) Why you never visited him all those 12 years?
Answer: He has been visiting India every year.
    4) Do you have kids?
    Answer: no
    5) Where do you work?
    Answer: govt officer

    Brother in law:
    1) How many countries have to visited?
    Answer: Canada and Cuba
    2) What were you doing in Canada?
    Answer: Studied + work
    3) Why did you move to India?
    Answer: pursue business.

Visa officer said that your visa is not approved at this time.

What could be the criteria for denial. My sister in a govt officer and brother in law has his own business. They just wanted to visit me in USA for a month.
Should they appear for another interview in other location?
Also, I have a cousin in USA who is graduating this summer. Can he invite my sister in his graduation ceremony as he can get invitation letter from university? Will it help getting visitor visa after denied for first time?

    please advise.

We can only guess the reason for denial. You or (the applicant) are the best one to judge what could be the reason.
Your sister & brother-in-law needed to prove strong ties to home country to secure the visa.
For example, a regular high income, some property in their own name, better reason for the visit (like attending one of your regional ritual)

Yes, graduation ceremony could be a good reason, for immediate relative, but not for cousins.

I would suggest them to wait for an year or two before re-applying & by that time, try to analyze what could be the reason.
