  • Getting B2 Visitor visa from non home country

I had a few questions on procuring visitor visa that I was hoping someone might be able to answer.

We are a family of 4, here in US on my L1-A.

My Mother-in-law (aged 72), an Indian passport holder, is currently on Super-Visa in Canada (with my wife’s sister, who is a CA permanent resident). This is her First of 5 potential Super-visa terms over 10 years. When this Super-Visa term (2 years of continued presence) expires, we would like to bring her to US for 6 months, and have her return back to CA for another 2 year term. She doesn’t have a US Visitor Visa right now, which we need to apply for her to visit us in the US. Given her age, we want to minimize travel to India.

Few questions that I wanted to get answered:
    1. Will she be able to apply for move directly from Canada to US on this Super visa term completion, without needing to go back to the Home country before coming to the US?
    2. Will there be any problem for her to move back to Canada for the second term of her Super-Visa directly from the US, without needing to go to the home country?
    3. Can she apply and receive her US visitor visa in Canada without needing to go to India to apply and stamp?
Appreciate any help, and thanks in advance!

    Thanks!

To get an US Visitor visa, you need to prove strong ties to your home country. Legally you can apply for US visa from Canada, but since she is not "living" in India - it will decrease the chances of visa approval.

Also, long term stay in Canada shows that she is dependent on either of her daughter & its not good sign for US visitor visa.
