Applying for Visitors VISA when H1 (I-94) expiring

I have taken an appointment in July for my parents visitor visa. I entered tentative travel date as 01-oct-2010 when my I-94 is expiring on Oct 31st. My employer haven't applied for H1-B extension yet. I still have 1.5yrs left on my 6yr max.

1) Will that be a problem for my parents Visitors visa? Do they see my I-797 petition date and may approve only for a month?

2) Do I need to wait for my employer to file H1B extension and send the receipt notice to my parents.
