  • Problem of Original Birth Certificate

    Hi,

I want to bring my parents and sister to USA for couple of months on tourist Visa.

Can you please suggest, What does original Birth Certificate means? My parents have my Nursing Home birth certificate, but my name is not mentioned there. I have lost Municipal Corporation Birth Certificate and it is hard to get a copy of it from corporation. My parents have my 10th Standard Registration Card (Admit Card is with me in US), in which my date of birth is mentioned. Will it work? Is there any other way out for my Birth Certificate, like letter from local councillor.

We submitted DS-160 forms separately for all family members (not choosing the family member option) but taken Interview appointment together. Now I am planning to send only one set of sponsor's document. Will it be a problem?

My sister is currently doing fulltime job on contract basis (contract will be renewed every year). Will she require to produce proof of leave grant from the office?
Also she has joined one fulltime course. Showing the proof of that course will help or have negative impact as she is doing the fulltime job same time?

As per showing the tie, like my parents have unmarried daughter, but she is also going to attend Visa Interview along with them. Can they show that as tie?

We have two tempales in our house. My parents are the sevayat of the deities of that temple. Can they show that as tie?

    Thanks in advance.

You didn't say your status in the US. But assuming that you are naturalized or a LPR, then that would suffice logically speaking.

      Problem of Original Birth Certificate

      Hi,

      Thanks for your reply.

      I am in H1B Visa.

I have lost Municipal Corporation Birth Certificate and it is hard to get a copy of it from corporation.

So, can my Nursing Home birth certificate (but my name is not mentioned there) or my 10th Standard Registration Card (Admit Card is with me in US), in which my date of birth is mentioned will work?

Also my sister is currently doing fulltime job on contract basis (contract will be renewed every year) and it is shown in DS-160 form. Will she require to produce proof of leave grant from the office?

      Thanks,

Here is my experience and you can propabily use this as a Yardstick of what the Consulate may say.

        -- 1st Trip to consulate

When I applied for my green card 10 years ago and went to the consulate (CP processing) for my GC. I had produced a no availability certificate which was destroyed in the flood in the record office , birth and deaths) from the municipality and 2 Affadavits from my father & uncle to prove my DOB ( This was accepted and my GC was issues.

-- 2nd recent Trip to consulate

I had applied for a Green card for my mother. They wanted my Birth certificate, as I had the original non availibility from the Municipality ( Of the two affadavits they took both the original during my GC), so I executed 2 more affadavits from my family members.

Suprise, suprise... the officer who review the documents began to bitch about me using affadavits, I explain that this was the same non availabilty that was used in the same consulate in 2000 for my GC, but was told, Oh you know we now demand a certificate to be issue my the Mulicipality etc, etc. They asked for additional supporting documents like my old expired Indian passport that has my mothers name (I said sorry I don't have it). She said well I am going to write a note and have the interviewing officer decided if he needs further evidence.

In short I would suggest just drop a letter to the municipality, they will give you a Birth Cert or a Non availability Cert. One of these will be required, you can always supplement these with additonal documents like school cert etc.

Primary document they do need so its a bot painful but try to get one, this will get you a better change of success and un-necessary -ve when your case is being reviewed.

For visitor visas of your parents and sister, your birth certificate is not a necessary (but recommended) document. They may be asked to prove their relationship to you. But, usually this does not happen since Visitor visa is not really a dependent visa. They can take any other official document which shows that they are your parents.
They should know your job status, employer, location etc. They should have some idea of which places in the US they will visit and how long will they stay there. They should also have property, job or some such tie about which they may be questioned. Your sister may be questioned about her job, education etc. Most applicants are hardly ever required to show any documents.
This is my opinion and not legal advice.

Based on kabkaba looks like you are good with what you have.

Just have other supporting docs like Passport Photocopy that shows your relationship and you are good.
