Can i apply for second B2 Visitor Visa extension for my mom?

  • Can i apply for second B2 Visitor Visa extension for my mom?

    My mom travelled to USA & landed here on Dec17 ,2019 & we applied for her extension of stay on Apr 07,2020 since COVID hit big time. We got an approval on Jan28,2021 but the approval date was only valid till Dec16,2020. She is a senior with a Type 2 diabetes & High blood pressure & i would not want to not risk her travelling w/o any vaccination.Also her B2 Visa expires 08 May 2021. What are our options now? Appreciate any help in this regard.

    You should consult an attorney soon, technically your mom is overstaying at this point of time.

      She should have applied for a second Extension of Stay before the 6 months she requested on her first EOS ended. That would have allowed her to continue to stay now (because the second EOS would have been filed during the period she was approved for by her first EOS). However, she cannot apply for Extension of Stay now because she is already out of status.

        Hi,
        Thanks all - i did consult an Immigration attorney today & he said to apply for 2nd extension ASAP. It would be on the discretion of the USCIS officials to approve / deny it.
        I had called the USCIS helpline when the application was in progress & they did tell me that unless the 1st application is approved / denied, the 2nd application would not matter, now i do not have any proof of the same, since it was on a call, but i would apply for the 2nd extension & hope for the best now !

          May I ask what does the lawyer say upon your mum's status while she is applying the 2nd application. Since she is considered out of status after Dec16 2021?

            Hi,
            Yes the lawyer did say that technically, she is out of status since Dec16,2021 but its up to USCIS 's discretion considering all that has been happening around the world & they may consider the late application, so i did apply for the 2nd extension regardless.

              Did you find the solution? My Mom also has Type 2 diabetes. She has already found proper insurance, but any updates are appreciated.

                Speaking about diabetes, what meds she takes? Recently my grandfather was diagnosed with diabetes type II so I Buy Trulicity Online for him but I just want to find some reviews of various meds to find the best option. I also heard a lot about Ozempic but mostly that people take it for weight loss.
