  • B-1 visa rejectionand another interview

    Hello,

    A week ago, I got a B-1 rejection.

My situation is that I am studying for the Canadian bar exam. In order to complete their procedure, I have to work for free in legal field.

As I studied in the US in 2019, I can get a free legal work in New York State.

My purpose is to do internship, free work.

I explained about this circumstance but the visa officer think it was like "just I want to go to Canada."

B-1/B-2 is for business and pleasure category.

    I got a rejection due to 216 (a). A strong tie.

I am from Korea but I live in Hong Kong. My job is in Hong Kong.

My purpose is to complete the job requirement. I mean, the employer will hire me only when I complete the procedure.

I also have a current job in research. But I think the officer in the Consulate in Hong Kong does not take seriously about the researching job which was written in DS 160.

I am teaching too; but I just mentioned the pandemic and unavailable chances of teaching.

Job can be explained next time.

Also, I had a letter from the Senate Member. But they read after my interview.

Can anyone help in order to get a visa?

    regards

    Hi,
When you apply for B visa and if you say you are going to work under that visa will make some clauses and this is not requirement of B visa. Instead of trying to obtain B visa, you can try for any other Non-Immigrant visa which will help you to work and gain the knowledge.
    Thanks

one cannot perform labor in the US with a B1, paid or not, nor do our laws bend just because some company claims that someone 'must' do something in violation of those laws in the US...that excuse of 'it is a requirement of my upcoming job...blah blah blah' is one of the most overused and least credible excuses a CO hears everyday...
