  • Question about Tourist Visa and Marriage

    Hi,

I am living in Canada on PR. I have an IT job here, bank balance, driving license, employment letter, pay stubs and other documents. My fiance lives in US. She is a green card holder.

We are planning to marry in November and we want to perform the marriage at her residence in US. I have applied for tourist visa and soon will be going for the visa interview. Now, I am a bit confused here. Lot of people told me not to mention that you are going to marry there. They advised I should just say that I am going for tourism and then marry there. Else, if US consulate comes to know that if I am going for marriage then they will never give me Visa.

Now, as per my understanding the problem is not marriage but STAYING there after marriage and not returning back. But, I have no such intentions to stay there. I just want to marry there and we want to come to Canada then as I have to resume my job and other tasks.

So, I am very confused here. I want to true and want to provide the documents to prove that I have ties in Canada and will return back. But, what is the general consensus on this issue? How should I go about this?

    Thanks.

You cannot enter US on a tourist visa and marry, it would be considered fraud. A tourist visa is for just that visiting.
When asked, what's the reason for your visit and you told them you were intending to marry a US citizen then they will deny your visa.
And your friends who told you to lie could just make it worse for you and you could be denied re entry to the US in future if you married on tourist visa.
My suggestion to you is for your fiance to file a 129F petition a fiance visa and enter the states legally and marry then within 90 days.
If you have not done this then I suggest you get started but you wont be eady to marry by November. Petition takes a few months for approval as long as you and your fiance have all the applicable
documents. Please read USCIS site on K1 visa. Truly it is the best and legal way to enter or read link below.
