  • B2 to L2 Visa

    I need help. I am currently on L1 Visa and my fiancé is an Indian citizen who is in Australia and holds an Australian PR. Due to travel restrictions because of COVID, i cant travel to Australia or in India to get married.
    Can my fiancé apply for a B2 visa on grounds of getting married to me (L1 visa) and we can apply for a change of status to L2 from USA once we get married? Is it allowed.. or if allowed will it impact the GC process later?

    Hi,
    As you mentioned you will travel to either India or Australia for getting marriage then why do you need B visa again? If you get marry out side of USA then you can get dependent visa to her directly. I don't really think, you will have problem on GC filing in future.

      Thanks for you reply, but the issue as I mentioned is that I cannot travel to India to Australia at the moment because of travel restrictions. So the only option is getting married in USA.. hence I need some guidance on this.

        in this case, yes you can try for B visa.. But, B visa applicant need to provide truth Answer to officer at the time of Interview..
