    My mom and dad are US green card holders for almost 5 years now. Me and my wife are not living in USA and we are not US citizens.

    On 2016, my wife was pregnant, she applied for a US B2 visa for the intention of giving birth, this is what she declared in the interview with the consular. She showed that we are financially capable of covering all expenses. She got the visa and went for giving birth.

    When she arrived USA, my dad managed to get my wife an insurance with blue cross blue shield company (although she’s a B2 visitor so not sure how he did it). She gave birth and the insurance covered 80% of the costs and we covered 20% + the monthly insurance fees (which was being paid before birth by 3 months and continued for 2/3 years). When the baby came to life, the baby wasn’t covered as it was missed and there was something like 2000$ costs for the baby which got paid by medicaid since she’s (the baby) a US citizen. This was paid after my wife departed USA, my dad did this and we didn’t know and we weren’t happy with it.

    We went to the USA for tourism on 2017.

    On 2019, my wife was pregnant and she went to give birth again. She had medical insurance with blue cross blue shield which she got on 2016. We covered 20% of the expenses and blue cross covered 80% (including any charges for the baby as we managed to include the baby on this insurance package). No medicaid was used.

    2021, my wife went to the embassy to get a new B2 visa as the first one expired. She wasn’t pregnant, she said the reason for this visit is to visit father and mother in law with the kids, my visa was not expired yet, it had 7 months so I didn’t go with my wife. She got the visa. Due to covid, we weren’t able to travel to USA for visiting them.

    After 4 months, I went to get my B2 visa as well but my wife was pregnant in month 2. I told the consular my main reason for the visit is to see my mom and dad, my dad is a cancer patient and I haven’t seen him for 2 years now. The consular asked me if my wife and kids have a valid visa, I told her yes my wife has and my kids are US citizens. She was somehow shocked. She told me do you intend to give birth again in the US, I told her I don’t know. Then she asked if my wife is pregnant, I told her yes she is. She then said that there are new rules regarding birth tourism and we can’t give birth there. She cancelled my current visa which had 3 months remaining and she rejected my new visa request. She said I can apply again after birth.

    When I reached home same day, they called my wife and asked her to go meet the consular second day.

    We prepared medical proof that she wasn’t pregnant at the time of her interview and that there are some complications were the birth could end (which is true). They told her you can take your passport, but don’t use the visa until we call you. They took from her the medical reports + medical expenses for both previous baby births (which was the 20% we paid).

    Now, 1.5 months passed and they haven’t called us.

    My questions are:

    1- Is there a risk of denying our B2 visas now or in the future due to the blue cross insurance or the medicaid my first baby got in 2016 for 2k USD?

    2- If they called us an said the wife visa is ok and you can use it, can my wife use it for giving birth in USA? Of course we intend to pay everything without any insurance.

    3- what’s the reason for this delay, they said they will get back to us after 10 days and it’s 1.5 months now? We plan to call the embassy.
