    Hello Team,

    My mother-in-law is in US with B2 visa. She came in US on 11/28/2020. So her I-94 authorized stay was for 6months till 05/27/2021. We applied for her extension for another 6 months till 11/27/2021. We haven’t received any approval from USCIS. However, she missed one biometric appointment due to medical reason. Now we are planning to extend her stay for another few moths beyond 11/27/2021. I have heard the suggested time for filing the extension would be at least 40days prior to the date before expiry. Is it fine if we file the extension now?

    Appreciate a quick response here.

    B2 visas are not for (a) providing child care and (b) to live in the US, pretending to be a tourist. When other folks face challenges getting B2 visas, this sort of abuse is why.

      Yes. It just needs to be officially received by USCIS before her status expires. We don't know how long her status will be granted by the first extension of stay, if it is granted, but assuming it is granted for 6 months, sending the second extension of stay now should be fine.

        Hi Member,
        Yes. You can file.. But, probably you may expect RFE on either of the petition to request maintenance of status at the time of filing petition. If you get decision on first extension will not have any issues. If first extension will be still pending for long time then you may have some complications.
        And also, as other Senior member mentioned, If your first extension gets approved for 6 months you may not meet any complications at all.
