  • Visit US after previous stay with extension

    Hello

my in-laws were here came in Dec-2020 and left to india in Sep-2021, extended stay due to pandemic situation. However we have again some family function and like to comeback in Feb 1st week. That would put them only 130 days from their previous departure from US.
Will there be any risk of deportation or denial of entry at port of entry? What’s the best way to convince the immigration officer and will it be risk to even travel?

Spending 10 months here and then only being away four months will certainly get some scrutiny. There is no official time limit on how soon you can revisit the US. A lot will depend on why their coming back and what the prognosis for them leaving in a timely manner is.

      Hi Member,

Answer: As per my knowledge, as long as you have a genuine reason to come back and not violating any rules then it should be ok to travel.. Just give a truth answer at port of entry and move forward.
By the way, did you get extension petition approval?
      Thanks
