  • Filed i-539 but no response and time to depart

    Hello,

My parents filled for a B1/B2 extension(i-539) before their I-94 expiration but we still have not received any response. They completed their biometrics but that's the last of it. When I check the case status it shows "Case Was Updated To Show Fingerprints Were Taken" that's all. I had requested an extension until April-7-22 and they are departing via plane on April-1-22.

Is there anything we need to do like updating uscis etc? or just leave everything as is?

    Please suggest.

They don't need to do anything. They should hold onto the I-539 receipt, and any future decision notice, to prove that they left while it was pending for when they enter in the future.

This is my personal opinion and is not to be construed as legal advice.

Would they not reject the application similar to COS, Once you left the country, there is nothing to approve the application?
