I-94 and I-485/I-130 Help

Hi,

I am using concurrent filing to obtain permanent residence for my wife. She entered on the visa waiver program. Everything is clear for us except one issue. The I-94... which is a required document on the I-485... but is out of date. The I-94 is no longer used as ESTA has taken over. So, what do I do about the I-94?

Person can't extend the stay beyond 90 days while entering on visa waiver proram. Therefore, she is out of status and therefore, I-485 can not be applied.
