  • my parents visa rejected-214b

    My parents went to Chennai consulate on Feb 16th 2005 and a lady there rejected their VISA under 214b . My husband was sponsoring them... he is a New Zealand citizen.

    These are the questions she asked......." didn't let my dad talk much......only wanted answers from my mom"..... had a telugu translator.

    Who is there in america? my daughter and son-in-law
    Do they have children? no...(we don't have kids)
    what company does your son-in-law work for?
    How many children do you have? 2 daughters.
    Where is your other child? here......... where here? In some place in A.P
    what do you want to do for 3 months in US? See my daughter, son-in-law and visit places like California, Vegas........
    what does your daughter do? Housewife
    Can you pass the papers your son-in-law sent to you.

    .......then she just flipped some documents and paused a while at my husband's passport copy...........asked who is from New Zealand? son-in-law.
    then she checked bank statements and other papers we sent from here (not my passport copy) ......... didn't even look at my parents documents like their financial documents, affidavits and stuff in India.

    That lady rejected 6 people out of 8 (other 2 are H4 visas)........... Other male interviewing officers were good....they rejected few but granted for others.

    How do I prove that they cant be judged as potential immigrants under 214(b).

    My husband recently got his Green Card ...Anyway we sent his passport copy 2 months back, so we haven’t sent the green card papers and he just filled I-134 as a H1 ( 2 months back he didn't have his Green card). Would filing with green card be a credit? Also what does Act 214b mean? and how soon can they re-apply? also let me know if we can put our new home under our assets here.

    Any help would be appreciated.

      Questions about re-applying for visitor visa

      My parents visa got rejected recently...I have some questions on re-applying.

      When we applied for Visitor visa, we didn't have a green card so we filed as a H1. Now when we are planning to re-apply, would filing with green card and having a home here in America indicate that we don't have ties with our country? (My husband has recently been to India...Shouldn't this prove his ties there) Also what does Act 214b mean? And how soon can we re-apply for my parents?
      Any help would be appreciated.
