  • Can I enter the US with an one-way ticket if I apply for green card during my visit?

My immediate family is having their citizenship interview soon, and I plan on going to the US soon after they get their citizenship. They will apply for my green card during my stay in the US. I currently have a B1/B2 visa. Would it be a problem if I enter the US with intentions of getting a green card? And can I buy just an one-way ticket? Thanks!

It would be a problem if you enter the US with intentions of applying for Adjustment of Status (the process of getting a green card from within the US) during this stay.

This is my personal opinion and is not to be construed as legal advice.

When you "try to" enter into USA using B1/B2 visa, at POE you'll have to prove that your current visit in matching the requirement of non-immigrant visa & you'll surely return once the purpose of trip is met. If you fail to prove that to VO, they will deport you right there.
