  • Can a Canadian who was inspected and admitted adjust their status?

    Hi everyone,

I am new here. Hope everyone is doing well and staying safe.
I am a Canadian citizen in Toronto. My partner is a US citizen in New York. We are both in the US currently. I was inspected and admitted, but I don’t have a B2 Visa.
If we get married in the future, can I adjust my status? If I can, what would my status be?

    Thank you in advance.

Yes. You were admitted in B2 status.

This is my personal opinion and is not to be construed as legal advice.

Yep, my wife and I did the same thing.

Thank you both for the quick replies. I just pulled my I-94 and noticed that I was not issued any status. If I was not issued B2, do I still have B2? I looked at my history today and noticed I was only issued B2 when I flew using a passport. Through the land border with Nexus, there is nothing except entry and exit on my record. Could I still adjust my status in this situation? Thank you everyone.

Perhaps the land border entry was treated as automatic revalidation? They often don't issue new I-94s for automatic revalidation (a trip of less than 30 days to Canada or Mexico and the previous I-94 was still valid).

This is my personal opinion and is not to be construed as legal advice.
