My friend (also a distant 3rd cousin) came to the US on an O1.
Subsequently he made a CoS application to a B1/B2 and travelled around the US. There were a few rescheduled biometric appointments (offices had covid rules at the time) but eventually he got one done. There was an extension that was filed to this B1 application. Before getting a decision he left the US for home. After about a month, he received information (via check status tool) that the application was denied. He presently does not have any US visas and is looking to apply for a B1/B2 or maybe an O1 (he is an expert in his field and very well known).
Was he an illegal between the time he left his O1 status and left the US (around 9 months ?)
Will the denial cause any issues in getting his visa or when re-entering the USA ? Should my cousin appeal ??? What are the options here ?
