  • H1-B expiring in August, will it cause a problem for Visitor visa app?

    Hi,
I am planning to get an appointment for Visitor Visa for my mother, in July 2005. But my H1-B (second term) is expiring in August 2005. My green card application has been pending for a year, so I am going to apply for H1-B extension around June.

Will my H1-B expiring in August, cause any problem for the Visitor visa application ?

    Thank you,
    Chandra.

Would you recommend sending the H1-B extension application papers to my mother. To show proof to the Visa officer.. that I will be staying in US, legally after my current "Notice of Action" expires?

Thank you very much for taking time to respond to my questions.
      Chandra.

Your mother might only get a single entry 6-month visa. If your H-1 is valid for a longer term (say 2yrs from now), more chances that she will get a 10-yr multiple entry visa. This is based on mine and couple of friends' experiences.
My mother got a multiple entry 6-month visa when we applied for visa in Feb '01 and my H-1 expiry date was Aug-01 which is exactly 6 months away from the tourist visa application date.
My cousin's parents got a 1-yr multiple entry visa and their visa end date was same as his H-1 expiration date which is Mar-05. They applied in Apr-04 in Chennai consulate.
My friend's parents got a 10-yr multiple entry visa and his H-1 was valid for over 2 yrs at that time (back in 2003 - Mumbai consulate)

Based on such cases above, I suggest you apply for a tourist visa for your mother after you renew your H-1 visa and have it stamped in your passport. If your mom needs to visit you soon, then as immihelp adminstrator suggested, she will get the visa without a problem - be it a single entry or multiple entry visa.
